Official Rules

2024 BREWSTER EDUCATION FOUNDATION JEEP WRANGLER UNLIMITED RAFFLE OFFICIAL RULES: By participating, entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which shall be binding and final as to all matters related to the Brewster Education Foundation Jeep raffle for a vehicle as described below (the “Raffle”). The Raffle is subject to all applicable federal, state and local laws.

SPONSOR: Brewster Education Foundation, P.O. BOX 320 BREWSTER, NY 10509 (“Sponsor”).

NET PROCEEDS: All net proceeds of the Raffle will benefit Sponsor, a 501(c) (3) charity, and the programs that Sponsor supports. Programs include, but are not limited to, educational materials, grants, and scholarships for the Brewster Central School District.

ELIGIBILITY TO ENTER: During the Entry Period specified below, Raffle tickets may be purchased in accordance with these Official Rules either at BEF.org or any of the participating in-person locations starting November 6, 2023. Anyone, regardless of their state of residence, may purchase Raffle tickets, but vehicle pickup is in Carmel, New York. The car will not be shipped.

ENTRY PERIOD: The Raffle entry period is between 7:00 a.m. Eastern Time ("ET") on November 6, 2023 ("Start Date"), through 11:59 p.m. on January 18, 2024 ("Entry Period.”) A maximum of 1,000 tickets will be sold. The drawing will be held on Friday, January 19, 2024 at Brewster’s Got Talent. In the event of a weather-related cancellation, the raffle will be held on Saturday, January 20, 2024.

PURCHASING RAFFLE ENTRIES: Raffle tickets may be purchased for one hundred dollars ($100.00) each or three (3) tickets for two hundred fifty ($250.00), by eligible persons (see "ELIGIBILITY TO ENTER" above). Credit card fees will be applied to your purchase if you choose to use a credit card. ($104, $260)

TRANSFER/RESALE OF RAFFLE ENTRIES: Persons who purchase Raffle tickets may opt to give away or otherwise transfer their Raffle tickets to others, but in doing so they give up any claim they might otherwise have to the Prize if they surrender a winning Raffle ticket. Raffle tickets purchased may be given away to persons who are under 18 years of age, but only individuals who are 18 years of age or older may claim or win a Prize.

EARLY BIRD DRAWING: There will be an Early Bird Drawing on Friday, December 1 at the Brewster Education Foundation Winter Wonderland. If you have purchased a ticket online prior to 11:59 p.m on Thursday, November 30, or in person prior to 8:00 p.m. on Friday, December 1, you will be automatically entered to win one of 10 additional raffle tickets. The drawing will take place live at the event.

PRIZES: One (1) 2024 Jeep Wrangler 2-Door Sport (the “Grand Prize”) OR $25,000 cash and ten (10) early bird prizes will be awarded at the sole discretion of Sponsor as follows: December 1, 2023 – Early Bird Raffle; January 19, 2024 – Grand Prize Drawing. The winner has the option to decline the vehicle and take the cash option.

For Grand Prize Vehicle: Official Winner is responsible for vehicle registration, license, title and insurance fees and any other expenses related to the acceptance and use of the prize not specified herein. Grand Prize Winner will be required to provide proof of possessing a valid U.S. automobile driver’s license in good standing as well as appropriate automobile motor vehicle insurance prior to the vehicle being awarded. If the Grand Prize Winner fails to provide such proof of possessing a valid automobile driver’s license and/or appropriate automobile motor vehicle insurance, the Grand Prize may be forfeited and the prize may be awarded to an alternate winner. Grand Prize Winner shall bear all risk of loss or damage to his/her vehicle after he/she has taken delivery of vehicle. Exact model, color, and options of vehicle and exact vehicle to be awarded are at the sole discretion of Sponsor and subject to availability from manufacturer. EXCEPT AS STATED IN THE MANUFACTURER’S LIMITED WARRANTY FOR THE VEHICLE, THE RELEASED PARTIES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OR ENJOYMENT OF THE VEHICLE, INCLUDING, WITHOUT LIMITATION, THEIR QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

NOTIFICATION OF POTENTIAL WINNERS: Owners of eligible entries need not be present in person on the Drawing Date in order to win. Sponsor will endeavor to contact the winning entry ("potential winner") by phone or email immediately after the Drawing, to notify such person that he/she is the potential winner, but only if and to the extent that Sponsor can successfully identify and contact such potential winner based on the identifying and contact information supplied by the entrant of the entry in question. POTENTIAL WINNER MUST CONTACT SPONSOR TO CLAIM HIS/HER PRIZE NO LATER THAN 11:59 P.M. ET FIVE (5) BUSINESS DAYS AFTER THE APPLICABLE DRAWING DATE (the owner of the winning ENTRY will have until January 26, 2024 to claim his/her Grand Prize) SO THAT SPONSOR MAY INSPECT AND VERIFY CLAIMANT'S RAFFLE TICKET (if applicable). If the potential winner has not claimed his/her Prize by following the procedures noted above and have not claimed the Prize by 11:59 p.m. ET on the fifth (5th) business day after the applicable original Drawing Date, he/she shall no longer be eligible to win the applicable Prize and a new potential winner will be selected from among all remaining eligible entries received as of the applicable Drawing Date Deadline. The same drawing, posting and notification procedures will be used. If the Prize/Grand Prize is not claimed by 11:59 p.m. ET on the fifth (5th) business day following the applicable new Drawing Date, the procedures in the preceding sentence will be repeated until an eligible entrant properly claims the Prize in the proper manner and within the proper time constraints.

DETERMINATION OF WINNERS: Sponsor shall have the sole discretion to determine whether the potential winners are Winners. Sponsor's decision concerning the identity of a Winner shall be final and binding. To become a Winner; (1) a potential winner must be eligible to participate in the Raffle under these Official Rules and must not be in violation of these Official Rules as determined in Sponsor's sole judgment; (2) that potential winner must contact Sponsor, or be contacted by Sponsor, by the deadline specified above under "NOTIFICATION OF POTENTIAL WINNERS"; (3) that potential winner's winning entry must be inspected and verified by Sponsor (4) that potential winner must provide Sponsor with all tax identification information required by federal, state or local law and, where applicable, provide Sponsor with payment for any required withholding taxes due prior to that potential winner's receipt of the Prize. If for any reason whatsoever all of the foregoing requirements are not satisfied with respect to a particular potential winner, or if Sponsor is unable for any reason to identify the entrant or contact a potential winner, then that potential winner's Prize will be deemed forfeited and, at Sponsor's sole discretion, an alternate potential winner of that Prize will be selected, through another random drawing from among all remaining eligible entries received as of the applicable Drawing Date Deadline in accordance with the procedures noted in "Notification of Potential Winners" above.

AWARD OF PRIZES TO OFFICIAL WINNERS: The Grand Prize will be awarded to the Grand Prize Winner and presented at a location determined by Sponsor at its sole discretion in 2024. Grand Prize Winner must accept his/her Grand Prize in person, unless Sponsor approves, in its sole discretion, other arrangements for the delivery of the Grand Prize. The Early Bird winners will automatically have an additional ticket entered into the drawing. Winners shall be solely responsible for their own transportation and other travel costs and lodging associated with accepting their prize.

TAXES: All federal, state and local income taxes are the sole responsibility of each Winner. The taxable value of the Prizes will be treated as ordinary income to the Winners for federal and state income tax purposes, and each Winner will be required by law to pre-pay a portion of the tax liability incurred in connection with his/her receipt of the applicable Prize before receiving his/her Prize from Sponsor.

RELEASE OF LIABILITY: Entrants, by participating in the Raffle, agree that the Brewster Education Foundation (collectively, the "Released Parties") will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for injuries, losses, costs, expenses or damages of any kind, including damages for death, personal injury, property damage or property loss, resulting from, whether in whole or in part or directly or indirectly, participation in this Raffle or the acceptance, possession, misuse or use of any entry or Prize.

PUBLICITY RELEASE: Each Winner, by accepting his/her Prize, grants Sponsor and Sponsor's designees and affiliates, including the Brewster Education Foundation full permission, except where legally prohibited, to use that Winner's name, address (city and state only), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity.

GOVERNING LAW; SEVERABILITY: The Raffle and these Official Rules shall be subject to and governed by the laws of the State of New York. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular persons or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules, and the application of all these Official Rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law.
